Holding

The writ petition is disposed, with the court directing that the pending Jamabandi cancellation case be concluded at the earliest.

Summary

The petitioner, Ramanand Prasad Jaisawal, sought a writ of mandamus directing the State officials to correct Jamabandi No. 296 for his 2.982½‑acre land, alleging that respondents colluded to issue duplicate receipts for 1.20½ decimal of the same land, leading to a pending cancellation case. He claimed bias and inaction by the Additional Collector, Purnea, who had kept the matter pending without reason. The petitioner also requested liberty for his family to approach the Additional Collector for redress. The court noted the pending Jamabandi Cancellation Case No. 1/2019‑20/42/2019‑20 and directed that it be concluded promptly. No substantive order to rectify the Jamabandi was issued; instead, the writ petition was disposed with the observation that the pending case should be taken to its logical conclusion. The petition was therefore dismissed without granting the writ.

Issues considered

  • What relief, if any, should be granted to correct the Jamabandi entry for the petitioner's land?
  • Whether the court should direct the Additional Collector to expedite the pending Jamabandi cancellation case.

Subjects

  • land dispute
  • jamabandi
