Holding

The writ petition was dismissed as withdrawn, with the Court finding merit in the respondents' objection of inordinate delay.

Summary

Vishal Kumar Ram filed a writ petition seeking to set aside a CRPF letter dated 16‑01‑2026 that rejected his compassionate appointment claim and to compel his appointment. The petition alleged the rejection was arbitrary and based on erroneous grounds. The respondents objected, highlighting the inordinate delay: the employee’s death occurred in 2000, the compassionate application was filed in 2018, and the writ was filed only in 2026. The Court found merit in the delay objection and, after the petitioner sought to withdraw, dismissed the application as withdrawn. Consequently, no order for appointment was made.

Issues considered

  • Whether the writ petition is maintainable given the inordinate delay between the death of the employee, the compassionate application, and the filing of the writ.
  • Whether the letter dated 16‑01‑2026 rejecting the petitioner’s compassionate appointment can be set aside.
  • Whether the court can direct the respondents to appoint the petitioner on compassionate grounds.
