Patna High Court

Rupesh Kumar SahversusThe Punjab National Bank

Decided
Disposal
DISMISSED

Holding

The petition is dismissed as the cheques were deposited after the expiry of their statutory validity period.

Summary

The petitioner, Rupesh Kumar Sah, alleged that he deposited two cheques of Rs.3,00,000 and Rs.3,21,000 with Punjab National Bank on 2 April 2025, but the bank failed to credit the amounts, claiming the cheques had expired. He sought a court order directing the bank to credit the sums with interest, produce CCTV footage of the deposit, and take action against errant bank officials. The bank counter‑claimed that the pay‑slip showed the cheques were actually deposited on 8 April 2025, after the three‑month validity period from the cheque date of 5 January 2025 had lapsed. The court examined the dates and found that the cheques were indeed out of the statutory three‑month validity period. Consequently, the court held that the petition had no merit and dismissed it, while leaving open other legal remedies for the petitioner. No specific statutory provisions or precedents were cited in the judgment.

Issues considered

  • bank liability

for the petitioner is entitled under law as
                                    well as on facts.”
                      3. It is the case of the petitioner that he has deposited

two cheques bearing Cheque No. 038927, amounting to Rs.

3,00,000/- and the Cheque No. 038928, amounting to Rs.

          3,21,000/- with the Respondent-Bank on 02.04.2025, however,

the authorities have not credited the amount to the petitioner.

                      4. Learned counsel appearing on behalf of the

petitioner submits that the authorities have deliberately not

credited the amount and informed the petitioner on 08.04.2025

that the validity of the cheques deposited by the petitioner has

expired. Learned counsel submits that in case, CCTV footage is

verified it would be clear that the petitioner has deposited the

above said cheques on 02.04.2025 that is within the validity

period and therefore seeks a direction from this Hon’ble Court

to direct the Respondent-Bank to verify the CCTV footage and

credit the amount due to the petitioner.

                      5. Learned counsel appearing on behalf of the

Respondent-Bank has drawn the attention of this Court to the

pay slip filed by the petitioner for depositing the above

mentioned cheques which clearly shows that the same was

deposited by the petitioner on 08.04.2025.

cheques that the validly period of the cheques is three months

                                 7. Having regard to the same, this Court does not find

any merit in the present writ petition and the same is dismissed.
