Kishore Kumar SinghversusThe State of Bihar

Decided

DISPOSED

Holding

The Court held that the writ petition must be dismissed as an alternative statutory remedy is available, and the petitioner should pursue an appeal before the appropriate authority.

Summary

Kishore Kumar Singh, a contractor, challenged a blacklisting order (Letter No. 144 dated 29.01.2026) that barred his registration under the Bihar Contractors Registration Rules, 2007 for ten years. He sought quashing of the order, a declaration that the underlying Order No. 154 was not a valid government decision, and a restraining order against any coercive action. The State argued that an alternative statutory remedy—an appeal before the concerned authority—was available. The Court, after hearing both sides, declined to interfere with the blacklisting order, directing the petitioner to file an appeal within 30 days. It held that the writ petition could not be entertained while a statutory remedy exists and consequently disposed of the writ application.

Issues considered

  • What is the appropriate remedy for a contractor aggrieved by a blacklisting order under the Bihar Contractors Registration Rules, 2007?
  • Can a High Court entertain a writ petition challenging an administrative order when an alternative statutory appeal is available?
