The Court held that the respondent must accept the applications for electrical connections and consider them in accordance with law.

Summary

A group of twelve petitioners filed a writ petition seeking a mandamus directing the Assistant Electrical Engineer (Respondent No.5) of South Bihar Power Distribution Company Ltd. to accept their applications for electrical connections and allow them to deposit the requisite fees for supply to premises in Rajiv Nagar and Digha, Patna. The respondents contended that the petition could be disposed with a direction to accept the applications. The Court, after hearing both sides, directed Respondent No.5 to accept the applications and consider them strictly in accordance with law within four weeks of receipt of the order. No specific statutory provisions or precedents were cited. The petition was consequently disposed with the said direction.

Issues considered

  • Whether the respondent authority is legally bound to accept the petitioners' applications for electricity connection and whether a writ of mandamus can be issued to compel such acceptance.
