Disposal
DISMISS FOR NON-PROSECUTION

Holding

The writ petition is dismissed for want of prosecution.

Summary

Binoy Kumar Gupta filed a writ petition seeking payment of compensation, statutory interest, and penal interest for land acquired by the State of Bihar. The petition also requested any other reliefs deemed appropriate. No counsel appeared on behalf of the petitioner, although the State was represented. The court noted multiple adjournments had been granted and, with the petitioner still absent, held that the petition could not be prosecuted further. Consequently, the writ petition was dismissed for want of prosecution.

Issues considered

  • What reliefs, if any, can be granted to the petitioner for compensation and interest under the Land Acquisition Act?
