Holding
The court held that the petitioner should seek redress from the District Collector and disposed of the writ petition.
Summary
The petitioner, Uday Pratap Singh, filed a writ petition in the Patna High Court seeking direction that the State authorities pay adequate compensation for land and building acquired for the Sherpur Dighwara Ring Road, alleging that the rates fixed (Rs 1200/ft and Rs 1150/ft) were lower than those prescribed in the new Bihar government rate chart. He also prayed for compound interest on delayed payment, relief under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and imposition of heavy costs on the erring authority. The State had no objection to the petitioner approaching the District Collector for redress. Justice Rajiv Roy, after hearing, granted the petitioner liberty to approach the Collector and disposed of the writ petition without further order. The court therefore did not entertain the substantive claim for revised compensation.
