Holding

The Court directed the petitioner to file a fresh representation before the District Programme Officer and the respondent to decide the claim within 90 days, thereby disposing the writ petition.

Summary

Sita Devi filed a writ petition seeking arrears of remuneration from June 2008 to the present, alleging that she was appointed under a 1998 letter but had not received salary after 2008 despite filing representations with various authorities. The petitioner’s counsel submitted the appointment letter and claimed that no action was taken on her representations. The Court examined the letter, noted the appointment under the Nasriganj district, and found no substantive adjudication on the claim. Accordingly, the Court directed the petitioner to file a fresh representation before the District Programme Officer (ICDS) within 30 days and allowed the respondent to decide the claim within 90 days of receipt. With these directions, the writ petition was disposed.
