Holding
The petition is disposed of in the same terms as Kumar Ohm, directing the District Magistrate‑Collector to consider the case under Section 64 of the RTFCLARR Act, 2013 and refer it to LARRA, Gaya.
Summary
Ram Pravesh Singh filed a writ petition seeking a direction that the District Magistrate‑Collector of Aurangabad refer his case to the Land Acquisition, Rehabilitation and Resettlement Authority (LARRA), Gaya under Section 64(1) of the RTFCLARR Act, 2013 and dispose of it within the period prescribed by Section 60(4). The petitioner urged the Court to apply the reasoning of the earlier judgment in Kumar Ohm v. State of Bihar (CWJC No.2743 of 2023), which had directed the same authority to consider the matter under Section 64 and refer it to LARRA, Gaya. The State counsel raised no objection to relying on that precedent. Justice Rajiv Roy noted the relevant portion of the Kumar Ohm order and held that the present petition should be disposed of on the same terms. Accordingly, the Court directed the District Magistrate‑Collector to act as ordered in the earlier case and dismissed the writ petition as disposed.
Issues considered
- Whether the District Magistrate‑Collector, Aurangabad, must refer the petitioner's case to LARRA Gaya under Section 64(1) of the RTFCLARR Act, 2013.
- Whether the petition should be disposed of in accordance with the precedent set in Kumar Ohm v. State of Bihar.
