Holding
The Court disposed of the writ petition, granting liberty to file representations before the Examination Controller and directing disposal of those representations within two months.
Summary
A group of 49 petitioners filed a writ petition before the Patna High Court seeking a mandamus directing the Bihar School Examination Board (BSEB) to consider objections raised through its portal regarding the Secondary Teacher Eligibility Test (STET) 2025 answer key, to publish a revised answer key, and to issue a corrected result. The petitioners also requested that the Board delete erroneous questions and award marks accordingly. The respondents, including the State of Bihar and officials of the BSEB, raised no objection to the petitioners' proposal to file separate representations before the Examination Controller. The Court, noting the limited nature of the relief sought, granted the petitioners liberty to file such representations within a week and directed the Examination Controller to dispose of them within two months, after hearing, with a reasoned order. Consequently, the writ application was disposed of, and any pending interlocutory applications were deemed disposed.
Issues considered
- What relief, if any, can be granted by a writ of mandamus directing the BSEB to consider objections and revise the STET 2025 answer key and result?
- Whether the petitioners should first approach the Examination Controller through representations before seeking judicial intervention?
- Whether the Court can impose a time‑frame for disposal of representations by the Examination Controller.
