Holding

The writ petition is disposed of, with the petitioner directed to approach the competent civil court for relief.

Summary

The petitioner, Md. Guljar Ahmed, filed a writ petition in the Patna High Court seeking the setting aside of two orders dated 23 November 2024 and 14 March 2024 issued by revenue officials in a mutation revision and appeal case. The petitioner alleged that the orders were erroneous and asked the Court to issue a writ restraining the respondents from acting on those orders pending resolution of the grievance. The Court heard the parties on 28 April 2026 and noted that the petitioner intended to approach the appropriate civil court for redress. No substantive discussion on the merits of the mutation orders was recorded. Consequently, the Court granted the petitioner liberty to approach the civil court and disposed of the writ petition without granting the relief sought.

Issues considered

  • What is the jurisdiction of the High Court to set aside the mutation revision and appeal orders dated 23‑11‑2024 and 14‑03‑2024?
  • Whether the petitioner is entitled to a writ restraining the revenue authorities from executing the impugned orders?
