Holding

Since the financial bid had already been opened and the contract awarded, the Court disposed of the writ application without granting any relief.

Summary

M/s Om Steel filed a writ petition challenging the e‑tender notice (NIT No. ICDS‑01/25‑26) issued by the Bihar ICDS Directorate for procuring utensil sets for Anganwadi centres, alleging that the eligibility and quality conditions were arbitrary, unreasonable, and violative of Articles 14 and 21 of the Constitution. The petitioner sought a certiorari to quash the notice and a mandamus directing a fresh, transparent tender. The respondents argued that the financial bids had already been opened and the contract awarded to private parties. The Court observed that, given the contract award, the petition could not be entertained further. Consequently, the writ application was disposed of without any relief being granted.

Issues considered

  • Whether the e‑tender notice and its eligibility/quality conditions violate Articles 14 and 21 of the Constitution.
  • Whether the High Court can quash the tender and direct a fresh procurement through certiorari and mandamus.
  • Whether the petition remains maintainable after the financial bids have been opened and the contract awarded.
