Patna High Court

Vijay Kumar,versusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court disposed of the petition, directing petitioners to file individual representations and the authorities to issue reasoned orders, without granting the requested old pension benefits.

Summary

The petitioners, a group of 61 government employees from Aurangabad district, filed a writ petition in 2022 seeking to remain under the old Bihar Pension Rule, 1961 and the General Provident Fund, arguing that the new Bihar Government Karamchari Anshdayi Pension Yojna (2005) should not apply to them. They requested the court to delete their names from the new pension scheme and to grant them benefits under the old scheme. The State of Bihar submitted that a Finance Department circular (Memo No.1206 dated 28‑11‑2023) had been issued, and the petitioners had made representations but no decision had been taken. The court observed that the petition was filed before the circular and directed the petitioners to file individual representations before the concerned departmental authorities within 30 days, and the authorities to pass a reasoned order within 90 days. Consequently, the writ petition was disposed of without granting the reliefs sought.

Issues considered

  • Whether the petitioners are entitled to continue under the old Bihar Pension Rule, 1961 and General Provident Fund despite the introduction of the new pension scheme in 2005.
  • Whether the court can compel the respondents to grant the old pension benefits without individual representations.
  • Effect of the Finance Department circular (Memo No.1206 dated 28‑11‑2023) on the petitioners' claim.
