Holding

The Court held that the petitioner should approach the Circle Officer for demarcation, and the matter will be taken to its logical conclusion.

Summary

Petitioner Punam Devi filed a writ petition seeking a court order directing the respondents to demarcate a parcel of land she purchased by registered deed. The land, located in Revenue Village Umdha, Saran district, was allegedly obstructed by private respondents without valid grounds. The petitioner’s counsel indicated an intention to approach the Circle Officer within four weeks for resolution. The State’s counsel argued that any such petition would be pursued to its logical conclusion. The Court disposed of the petition, directing the petitioner to approach the Circle Officer, who shall hear all parties and resolve the matter expeditiously.

Issues considered

  • Whether the petitioner is entitled to a writ directing the demarcation of her purchased land.
  • Whether the court can compel the administrative authority (Circle Officer) to undertake land demarcation.
  • Whether the petitioner should first approach the Circle Officer before seeking judicial intervention.

Subjects

  • land demarcation
