The writ petition is dismissed, and the matter is left to the District Transport Committee for reconsideration.

Summary

M/s Valiance Trading Pvt. Ltd. filed a writ petition before the Patna High Court seeking the revocation of a 2024 decision of the District Transport Committee that cancelled its transport contract, forfeited its earnest and security deposits and imposed a five‑year blacklist. The petitioner argued that it had submitted a final closure report and that a character certificate in its favour had been restored on 30‑03‑2026, and it relied on a Supreme Court order dated 09‑04‑2025 in SLP (C) No.5685/2025. The respondents contended that the restored certificate would be taken into account by the Committee and that a fresh decision would be taken promptly. The Court, after hearing counsel, disposed of the writ petition without granting the relief sought, indicating that the matter should be considered by the District Transport Committee. Consequently, the petition was dismissed.

Issues considered

  • The District Transport Committee’s 2024 decision cancelling the contract and imposing a blacklist can be set aside in view of the restored character certificate.
  • Whether the writ petition is maintainable for the purpose of directing the Committee to reconsider its earlier order.
