Holding

The Court held that the petitioner must be provided the documents and a reasonable time to file an explanation before any order, and disposed of the petition with those directions.

Summary

The petitioner, Amit Kumar, filed a writ petition challenging a show‑cause notice issued by Bihar Urban Infrastructure Development Corporation Ltd. (BUIDCo). The petitioner sought the documents on which the notice was based and an opportunity to file an explanation before any adverse order. The respondent BUIDCo argued that the petitioner would be provided the documents and a chance to be heard. The Court directed BUIDCo to furnish the requested documents, allow a reasonable time for the petitioner to submit his explanation, and then pass a reasoned order after considering the explanation. Emphasizing the principles of natural justice and equity, the Court disposed of the writ petition with these directions.
