Holding

The Court held that the writ petition is not maintainable where an alternative statutory appeal under Clause 32(3) of the Bihar Targeted Public Distribution System (Control) Order, 2016 is available.

Summary

Petitioner Kedar Singh filed a writ petition challenging actions of the State of Bihar and its officials. The Court examined whether the petition was maintainable given that the petitioner could appeal under Clause 32(3) of the Bihar Targeted Public Distribution System (Control) Order, 2016 before the District Magistrate‑cum‑Collector. The Court found that an alternative and efficacious statutory remedy existed, and therefore the writ petition could not be entertained. It directed the petitioner to file the appeal within two weeks and to be given a hearing, with the appeal to be decided within eight weeks. The writ petition was consequently disposed of.
