Ramchandra KumarversusThe Bihar Staff Selection Commission

Decided

DISMISSED

Holding

The petition is dismissed as infructuous because the result for the advertised post has already been published.

Summary

A group of petitioners filed a writ petition seeking a mandamus directing the Bihar Staff Selection Commission (BSSC) to publish the result of the office attendant examination held in September 2024 and to issue selection/appointment letters. The petition also sought consequential benefits. The BSSC raised a preliminary objection, contending that the petition's reliefs were no longer applicable because the result for Advertisement No.1/2018 had already been published. The court examined whether the petition remained maintainable in light of the purported publication. Concluding that the result had indeed been published, the court held the petition to be infructuous and dismissed it. No substantive merits on the mandamus claim were addressed as the relief sought was deemed moot.

Issues considered

  • Whether the writ petition seeking mandamus for publication of examination results is maintainable when the result has already been published.
  • Whether the petition becomes infructuous and therefore dismissible on the ground of mootness.
