Patna High Court

Chamru ManjhiversusThe State Of Bihar and Ors

Decided
Disposal
DISMISS FOR NON-PROSECUTION

Holding

The writ petition was dismissed for non‑prosecution as the petitioner failed to appear before the court.

Summary

Chamru Manjhi, a constable in the Bihar police, filed a writ petition seeking a certiorari to quash Memo No.1132 dated 14‑04‑2017, which ordered that 50 % of his salary be deducted and paid to his wife, Uttama Devi. The petitioner alleged that the order was illegal and sought its cancellation. No counsel or representative appeared on behalf of the petitioner on the scheduled hearing dates. The respondent’s counsel, Md. Nashrul Hoda Khan, was present. Since the petitioner failed to appear, the court dismissed the petition on the ground of non‑prosecution, without addressing the merits of the salary‑deduction order.
