Pushpa DeviversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The dispute relates to the appointment of the Anganwadi Sevika, so Rules 10.3 and 10.4 apply, and the petitioner is entitled to file an appeal within 30 days before the statutory appellate authority.

Summary

The petitioner, Pushpa Devi, challenged an order dated 07‑08‑2025 issued by the District Programme Officer, Samastipur, regarding her appointment as an Anganwadi Sevika. The State contended that the order could not be challenged under the 2011 Anganwadi Sevika Sahayika Margdarshan. The court examined Rules 10.3‑10.6 of the Margdarshan, which provide two separate appeal mechanisms: one for appointment decisions (Rules 10.3‑10.4) and another for procedural irregularities (Rules 10.5‑10.6). It held that the dispute pertained to the appointment itself, making Rules 10.3 and 10.4 applicable. Accordingly, the court granted the petitioner liberty to file an appeal before the statutory appellate authority within 30 days and disposed of the writ petition.

Issues considered

  • Whether the order of the District Programme Officer is challengeable under the 2011 Anganwadi Sevika Sahayika Margdarshan.
  • Which set of provisions (Rule 10.3‑10.4 or Rule 10.5‑10.6) governs the present dispute.
  • Whether the petitioner may be permitted to appeal before the statutory appellate authority within the prescribed period.

                            3. Learned Counsel for the State raised

preliminary objection that order of District Programme Officer

is challengeable under the Margdarshika for appointment of

         Aganbari Sevika Sahayika.

                            4. After hearing the parties, it transpires to this

Court that the advertisement for appointment of Anganwari

Sevika took place in the year 2013, appointment letter issued in

the year 2015, it is being guided by the Anganwari Sevika

Sahayika Margdarshan, 2011. Under the 2011 Margdarshika,

there is a provision of challenging order passed by District

Programme Officer within 30 days before the Deputy Director

Welfare or Additional Collector authorized by the Divisional

Commissioner, who has to pass order within 45 days.

                            6. Upon going through those provisions, it is

crystal clear that there are two forum of appeal are present. In

the first channel, the appointment on the post has subject to

Kendra is there which is 10.5 and 10.6. It is admitted that in the

present case the dispute is admittedly relating to appointment of

the Anganwari Sevika. Therefore, provision of 10.3 and 10.4

                      shall be applicable.
