Holding
The Court held that the petition should be disposed after the petitioner files a fresh representation and the respondent decides it, applying the earlier judgment if applicable.
Summary
The petitioner, Ram Babu Singh, filed a writ petition seeking to be placed in the 1st Assistant Commissioner of Police (ACP) pay scale of Rs. 4000‑6000 instead of the Rs. 3200‑4900 scale. The State argued that the petition is covered by the earlier judgment in LPA No. 458 of 2021. The petitioner had earlier submitted a representation on 1‑Feb‑2025 to the Deputy Inspector General of Police, but no decision was made. The Court directed the petitioner to file a fresh representation before the Deputy IG (respondent No. 4) within 30 days, and the respondent to decide the matter within 90 days, granting the benefit if the earlier judgment applies. The petition was thereafter disposed of.
Issues considered
- Whether the petitioner is entitled to the 1st ACP pay scale of Rs. 4000‑6000.
- Whether the earlier judgment in LPA No. 458 of 2021 governs the petitioner’s claim.
- Whether the petitioner must file a fresh representation before the Deputy IG for the matter to be decided.
