Holding

The court directed the petitioner to approach the Circle Officer for measurement and demarcation within three months, thereby disposing of the writ petition.

Summary

The petitioner, Nagendra Nath Singh, filed a writ petition seeking a court order directing revenue authorities to measure and demarcate his land (Khata No. 58, Plot No. 23) in Rohtas district. He alleged that the land had been under dispute since 2022 and requested relief to obtain peace of mind over his property. The coordinate bench had earlier directed the State to file an affidavit, which was not complied with within five months. The court noted its power to impose costs for further adjournments but instead directed the petitioner to approach the Circle Officer, Bikramganj, with a proper application and fee, mandating the officer to issue notice, fix a date, and conduct the measurement in the presence of all stakeholders. The court ordered that the entire procedure be completed within three months of receipt of the order and consequently disposed of the writ petition.

Issues considered

  • Whether the petitioner is entitled to a writ directing the revenue authorities to measure and demarcate the disputed land.
