The Court allowed withdrawal of the two settled petitions and directed the remaining petitioners to file representations, with the writs standing disposed pending the authority’s decision.
Summary
The Patna High Court heard a batch of civil writ petitions filed by retired senior accounts clerks against the State of Bihar. Two petitions (CWJC No. 7002 of 2024 and CWJC No. 7369 of 2024) were withdrawn after the petitioners’ grievances were settled, and the Court permitted their withdrawal. In the remaining petitions, the Court noted that the issues were covered by the Supreme Court’s decision in SLP (C) Nos. 8219‑8226 of 2019, which upheld the ACP and MACP schemes for financial relief to employees lacking promotion opportunities, and by a letter dated 27‑02‑2025 from the Principal Secretary, Finance Department. The Court directed the petitioners to file individual representations before the Principal Secretary, Water Resources Department, within 30 days, to be decided in accordance with the Bihar State Litigation Policy, 2011. The writ petitions were thereafter disposed pending those representations, and the respondents were instructed to pass orders on monetary benefits where applicable.
Issues considered
- The propriety of withdrawing writ petitions after settlement of grievances.
- Whether the petitioners are entitled to relief under the Supreme Court’s judgment on ACP/MACP schemes and the Finance Department’s letter.
- The procedure for filing representations before the Principal Secretary under the Bihar State Litigation Policy, 2011.
Subjects
- civil writ jurisdiction
- withdrawal of petition
- ACP scheme
- MACP scheme
- Bihar State Litigation Policy 2011
- Supreme Court precedent
- financial relief for government employees
- representation before Principal Secretary

6. Learned counsel appearing in the above-mentioned
writ petitions submits that in these cases, namely, CWJC No.
3207 of 2023, CWJC No. 8871 of 2024, CWJC No. 8918 of

hold that both ACP and MACP Schemes are schemes devised
with the object of ensuring that the employees who are unable to
avail of adequate promotional opportunities, get some relief in
the form of financial benefits.
7. Counsel further submits that a counter-affidavit has
been filed in CWJC No. 8918 of 2024, in which Letter No. 2178
dated 27.02.2025, issued by the Principal Secretary, Finance

8. Learned counsel for the State submits that in all the

one writ petition, i.e., CWJC No. 9223 of 2024, a representation

Department, Government of Bihar, Patna (Respondent No. 4),
Patna High Court CWJC No.7002 of 2024(9) dt.16-02-2026

within 30 days. The Principal Secretary shall decide the
petitioners’ representations in accordance with Clause 4.C of the
Bihar State Litigation Policy, 2011 within 60 days thereafter. If
