Patna High Court

Raj Narayan RayversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court ordered the petitioner to file a fresh representation before the District Panchayat Raj Officer and directed that officer to decide it within 90 days, thereby disposing of the writ petition.

Summary

The petitioner, a retired Panchayat Secretary, filed a writ petition seeking payment of his due salary and a differential amount after the grant of the first ACP. He alleged that multiple representations, the latest dated 25‑03‑2025 to the District Magistrate, had not been acted upon. The State argued that the court could merely direct timely disposal of the pending representation. The court directed the petitioner to file a fresh representation before the District Panchayat Raj Officer within 30 days, attaching a copy of the order, and instructed that officer to decide the matter within 90 days with a reasoned order. With these directions, the court disposed of the writ petition.
