Holding

The Court granted liberty to the petitioner to restore the earlier writ petition (CWJC No. 4411 of 2023).

Summary

Ajay Mandal filed a civil writ petition (CWJC No. 74 of 2026) seeking permission to revive an earlier writ petition (CWJC No. 4411 of 2023) that had been dismissed for non‑compliance with office objections. The petitioner argued that the earlier petition dealt with the same relief and therefore should be restored. The Court examined whether procedural lapse in the earlier case could be cured by granting liberty to restore it. It held that the petitioner was entitled to such liberty and ordered the earlier petition to be reinstated. Consequently, the present petition was disposed of as not pressed.

Issues considered

  • Whether the petitioner is entitled to liberty to restore a previously dismissed writ petition on the ground of non‑compliance of office objections.

Subjects

  • civil writ jurisdiction
  • restoration of petition
  • procedural non‑compliance
  • court order
  • petition dismissed
