Kailash Nath JhaversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The court disposed of the writ application without adjudicating its merits, directing the petitioner to file a representation before the District Magistrate within 15 days and the District Magistrate to decide it within three months with a reasoned order.

Summary

The petitioner, Kailash Nath Jha, filed a writ application seeking a writ of certiorari to quash a Gram Sarpanch order dated 19/05/23 that prohibited any activity on land bearing khata no. 219, kshetra no. 2282, and also requested the District Magistrate to verify the genuineness of settlement documents and, if forged, to initiate criminal proceedings. He further prayed that he be allowed to file a representation before the District Magistrate within a fixed time and that the Magistrate dispose of it promptly. The respondents raised no objection to this limited prayer. The High Court, without expressing any view on the merits or maintainability of the writ, disposed of the application at the admission stage, granting the petitioner liberty to file the representation within 15 days and directing the District Magistrate‑cum‑Collector to decide it within three months with a reasoned order. No final order on the substantive land dispute was issued and the writ application was consequently disposed.

Issues considered

  • Whether the petitioner is entitled to a writ of certiorari to quash the Gram Sarpanch's order restricting activity on the disputed land.
  • Whether the court may direct the petitioner to file a representation before the District Magistrate and prescribe time‑limits for such filing and disposal.
  • Whether the court should entertain the merits of the writ application at the admission stage.
