- DISPOSED
Holding
The Court granted liberty to the petitioner to file a fresh appeal before the Secretary, Rural Works Department, condoning the limitation period, and disposed of the writ petition.
Summary
The petitioner, a construction firm, challenged a two‑year blacklisting order issued by the Engineer‑in‑Chief, Rural Works Department, alleging it was illegal, mala‑fide and violative of natural justice. The petition also sought to quash a subsequent communication rejecting its representation and to compel the authorities to revoke the blacklisting. The respondents argued that the petitioner's appeal against the blacklisting was barred by the limitation period prescribed in Rule 11(E) of the Bihar Contractors Registration Rules, 2007, and that it was not filed before the proper authority. The Court held that the limitation objection could be condoned if the petitioner was given liberty to file a fresh appeal before the Secretary, Rural Works Department, within two weeks. Accordingly, the Court granted such liberty, directed the Secretary to consider the appeal on merits without being impeded by limitation, and ordered a reasoned decision within four weeks. The writ petition was thereafter disposed of on these terms.
Issues considered
- Whether the appeal against the blacklisting order is barred by the limitation period under Rule 11(E) of the Bihar Contractors Registration Rules, 2007.
- Whether the writ petition can be entertained despite the alleged limitation defect.
- Whether the Court can grant liberty to file a fresh appeal and condone the limitation period.
- Whether the blacklisting order should be set aside on grounds of illegality and violation of natural justice.
