The Land Acquisition Officer, Supaul, must take the pending compensation matter to its logical conclusion without further delay.

Summary

Maharani Devi filed a writ petition seeking the payment of compensatory amount for land (plot no. 8931) that had been acquired by the State of Bihar and its agencies. She alleged that despite the acquisition, no compensation had been paid, and her representation before the Land Acquisition Officer remained pending. The State counsel argued that the representation did not show any receipt by the officer. The petitioner indicated she would file a fresh petition with supporting documents. The Court, after hearing, directed the Land Acquisition Officer to conclude the matter at the earliest. Consequently, the petition was disposed with the order to the officer to take the matter to its logical conclusion.

Issues considered

  • What is the appropriate remedy for the petitioner when compensation for acquired land has not been paid?
