The Central Administrative Tribunal lacked territorial jurisdiction, and the petitioner was granted liberty to approach the appropriate tribunal.

Summary

Rahul Kumar filed a writ petition in the Patna High Court challenging an order dated 24.03.2026 of the Central Administrative Tribunal (Patna Bench) which dismissed his application on the ground of lack of territorial jurisdiction. The petitioner sought liberty to approach a tribunal having appropriate jurisdiction for his grievance. The High Court examined whether the CAT at Patna was competent to entertain the matter and whether the petitioner could be directed to a suitable forum. It held that the CAT indeed lacked territorial jurisdiction over the petitioner’s grievance. Consequently, the Court granted the liberty sought, allowing the petitioner to approach the appropriate tribunal. The writ petition was thereafter disposed of.

Issues considered

  • Whether the Central Administrative Tribunal, Patna Bench, had territorial jurisdiction to entertain the petitioner’s application.
