Patna High Court

Shiv Narayan SinghversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The Court may direct the administrative officer to dispose of the pending representation as the relief sought is limited to procedural compliance.

Summary

Shiv Narayan Singh filed a writ petition seeking a direction to the Circle Officer, Siswan, to dispose of a representation he submitted on 5 February 2026, which remained unconsidered. The State argued that the petition raised a disputed question of fact that should be addressed in a proper proceeding after hearing all parties. The Court noted that the petitioner's relief was limited to a procedural direction and did not involve substantive adjudication of facts. Accordingly, the Court held that it could issue a directive to the administrative officer to act within a specified time. The Court ordered the Circle Officer to dispose of the pending representation within three weeks and dismissed the writ application. The order was pronounced by Justice Rana Vikram Singh.

Issues considered

  • Whether a High Court can issue a writ directing an administrative officer to dispose of a pending representation.
  • Whether the petition raises a disputed question of fact that precludes judicial intervention.
