The Court directed the Superintendent of Police to ensure completion of the land demarcation within six weeks, acknowledging the petitioner’s senior citizen status under the 2007 Act.

Summary

Ashok Kumar Singh, a senior citizen, filed a writ petition in the Patna High Court seeking completion of land demarcation that was obstructed by local residents. He alleged that the authorities, including the Superintendent of Police, had failed to act despite his protection under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The petitioner had previously submitted a representation to the Collector of Panapur, which was also forwarded to the police. The Court noted the petitioner’s senior citizen status and directed the Superintendent of Police to take positive steps to complete the demarcation. The Court ordered that the demarcation be completed within six weeks and disposed of the petition.

Issues considered

  • Whether a senior citizen is entitled to protection under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 for the purpose of land demarcation.
  • Whether the administrative authorities have a duty to ensure timely demarcation of the petitioner’s land.
  • Whether the writ petition is maintainable and appropriate relief can be granted.
