Patna High Court

Satyendra KumarversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The writ petition is dismissed; the petitioner must file an appeal before the DCLR within thirty days.

Summary

The petitioner, Satyendra Kumar, purchased a plot of land and sought mutation of the title in his name. The Circle Officer, Bihta, refused to create the mutation, invoking Section 6(12) of the Bihar Mutation Act, 2011. The State argued that the District Collector's Land Records (DCLR) is the designated appellate authority under the Act, and the petitioner should pursue an appeal there. The High Court observed that Section 7 of the Bihar Mutation Act indeed makes the DCLR the appellate authority for orders of the Circle Officer. Consequently, the writ application was dismissed, with the Court directing the petitioner to file an appeal before the DCLR within thirty days, along with a condonation of delay petition if necessary.

Issues considered

  • Whether the order of the Circle Officer refusing mutation is amenable to writ jurisdiction.
  • Whether the petitioner must approach the DCLR as the statutory appellate authority under Section 7 of the Bihar Mutation Act, 2011.
  • Whether the writ petition can be entertained despite the existence of a specific statutory remedy.
