Patna High Court

Nisha KumariversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that the Collector’s order was based on a proper inquiry and there was no ground for interference, so the writ petition was dismissed.

Summary

Nisha Kumari filed a writ petition challenging the Collector’s order dated 24‑06‑2023 which dismissed her appeal against the selection of Kaushalaya Kumari as Anganbadi Sevika, alleging that the private respondent’s qualification certificate was forged. The petitioner sought a writ of certiorari and mandamus to quash the order and direct her selection. The State argued that the matter had been previously ordered by this Court in CWJC No. 6711/2020 directing a fresh consideration, which the Collector had complied with by conducting an inquiry and verifying the marksheet. The High Court examined the Collector’s findings, noted that the inquiry was duly conducted and the certificate was held genuine, and concluded that there was no ground for interference. Consequently, the writ petition was dismissed.

Issues considered

  • Whether the Collector’s order dismissing the appeal is perverse and liable to be set aside by a writ of certiorari.
  • Whether the allegation of a fake certificate warrants quashing the order and directing selection of the petitioner.
  • Whether the High Court can interfere with the administrative decision under the ICDS scheme.

Subjects

  • Anganwadi selection
  • ICDS
  • certiorari
  • mandamus
  • administrative law
  • fake certificate
  • child development scheme

                     3. Learned counsel appearing on behalf of the

petitioner submits that the order dated 24.06.2023 passed by the

Collector, Samastipur in Anganbari Appeal Case No. 47 of 2017

is wholly perverse, inasmuch as the certificate of the private

respondent is alleged to be fake, yet the same has been treated

as genuine by the authority. It is, therefore, contended that the

petitioner has been constrained to file the present writ petition.

                     4. Learned counsel appearing for the State, on the

other hand, submits that the petitioner had earlier approached

disposed of vide order dated 20.12.2021, directing the Collector,

Samastipur to consider the petitioner’s appeal after due notice to

the private respondent and to pass a reasoned and speaking

order in accordance with law. It is further submitted that,

pursuant thereto, the appellate authority has duly considered all

aspects of the matter and passed the impugned order. Therefore,

         no interference is warranted.

                     5. After hearing the parties and upon perusal of the

order dated 24.06.2023 passed by the Collector, Samastipur in

Anganbari Appeal Case No. 47 of 2017, this Court finds it

the marks obtained by the private respondent are genuine.
