Summary
A group of forty petitioners, former employees of the North Bihar Power Distribution Company Limited, challenged their termination as Man Power (Manav Bal) after the Labour Court, Purnia, in Reference Case No. 2 of 2021 declared the termination illegal. The petitioners filed a writ petition before the Patna High Court seeking reinstatement. During the hearing, counsel informed the Court that the Labour Court's decision had been rendered and that the respondents had not yet reinstated the petitioners. The petitioners then requested permission to withdraw the writ petition to facilitate their reinstatement by the respondents. The Court allowed the withdrawal, holding that the petition could be disposed of as withdrawn, and consequently dismissed the writ petition.
Issues considered
- Whether a writ petition seeking reinstatement can be withdrawn after a favourable decision of the Labour Court
