The writ petition is disposed, with the petitioners directed to approach the Deputy Collector, Land Reforms, Patna for redressal of their grievance.

Summary

The petitioners, a group of landowners, filed a writ petition seeking protection under Section 14(a) of the Bihar Bhoodan Yojna Act, 1954 to restore possession of land that had been allotted to their father/grandfather by the Bihar Bhoodan Committee. They also asked the court to direct private respondents to vacate the land and restrain any disturbance. The Bhoodan Committee informed the court that the revenue authorities had already initiated cancellation of the Jamabandi against the private respondents. The petitioners were advised to approach the Deputy Collector, Land Reforms, Patna for redressal of their grievance. Considering the limited relief sought and the steps already taken by the authorities, the court disposed of the writ petition, directing the petitioners to seek relief from the Deputy Collector.

Issues considered

  • Whether the petitioners are entitled to protection and restoration of possession under Section 14(a) of the Bihar Bhoodan Yojna Act, 1954.
  • Whether the court should direct the private respondents to vacate the land and restrain any disturbance.
