Patna High Court

Gudiya DeviversusThe State of Bihar

Decided

DISPOSED

Holding

The petition is disposed, allowing the petitioner to approach the Deputy Collector, Land Reforms, who shall hear the matter and take it to logical conclusion.

Summary

Gudiya Devi filed a writ petition seeking a direction that the Deputy Collector of Land Reforms and the Collector mutate her name in the land records, assign her a Jamabandi number, and issue a rent receipt. She contended that the order of the Circle Officer of Rafiganj was adverse and that she should be allowed to approach the Deputy Collector directly. The State of Bihar raised no objection to this approach. The Patna High Court examined whether the writ petition was the appropriate forum for such a relief. The Court held that the petitioner may approach the Deputy Collector, who will hear the matter and decide it administratively. Consequently, the writ petition was disposed, directing the petitioner to pursue the remedy before the Deputy Collector.

Issues considered

  • What relief, if any, can be granted by a writ petition for mutation of name, issuance of Jamabandi number, and rent receipt?
  • Whether the petitioner is permitted to approach the Deputy Collector of Land Reforms directly despite the order of the Circle Officer.
