The petition is disposed and the respondents are directed to pay the petitioner in accordance with the Pay Fixation‑Calculation Sheet.

Summary

Ramchandra Chaudhary filed a writ petition challenging an order dated 10‑07‑2024 issued by the Finance Department of Bihar, alleging it was erroneous in the context of his pending pay‑band case (No.17904/2022). The petitioner had earlier been directed by the High Court to make a representation to the authorities, after which a contrary order was issued. He submitted that the Pay Fixation‑Calculation Sheet (Annexure‑R/D) attached to the respondents' counter‑affidavit accurately reflected his entitlement, and that it conflicted with a later letter (Annexure‑R/F). The State argued that the counter‑affidavit clarified the matter and required no judicial interference. The Court, after noting the petitioner's satisfaction with Annexure‑R/D, incorporated the calculation sheet into the order and directed the respondents to pay the petitioner accordingly within three months. Consequently, the writ petition was disposed.

Issues considered

  • Whether the order dated 10‑07‑2024 issued by the Finance Department should be quashed.
  • Whether the petitioner is entitled to payment as per the Pay Fixation‑Calculation Sheet annexed by the respondents.

Subjects

  • pay fixation
  • civil writ jurisdiction
