Holding
The Court held that the Secretary, Transport Department, Government of Bihar must consider the petitioner’s representation and pass a reasoned order within ten weeks.
Summary
The petitioner, Sunil Kumar Singh, sought a writ of mandamus directing the Bihar Transport Department to grant him an ad‑hoc promotion to District Transport Officer, matching the promotion already given to his juniors, and to keep the post vacant until the petition is finally decided. He also requested the department to dispose of a pending representation (Annexure‑P/4) within a stipulated time. The Court, after hearing counsel, noted the pending representation and ordered the Secretary of the Transport Department to consider it, hold a hearing, and pass a reasoned order. The Court mandated that this exercise be completed within ten weeks from receipt of the order. Consequently, the writ petition was disposed of subject to the above directions.
