Holding
The petition is not maintainable before the Patna High Court as the cause of action arose within the jurisdiction of Chhattisgarh, and the petition is therefore dismissed.
Summary
The petitioner, a Head Constable of the Border Security Force, challenged his retirement on the ground of unsuitability under Rule 26 of the BSF Rules, 1969 and Rule 40 of the CCS (Pension) Rules, 1972, seeking a regular pension. The High Court examined a preliminary objection raised by the Union of India that the cause of action arose entirely in Chhattisgarh, where the competent authority had passed the retirement orders. The Court held that because the entire dispute originated within the territorial jurisdiction of Chhattisgarh, the Patna High Court lacked jurisdiction to entertain the writ. Consequently, the petition was dismissed with liberty to approach the appropriate court in Chhattisgarh within 90 days. The order disposes of the writ petition.
Issues considered
- Whether the Patna High Court has jurisdiction to entertain the writ petition challenging the retirement order of a BSF employee whose cause of action arose in Chhattisgarh?
- Whether the writ petition is maintainable before this Court?
