Birendra Kumar BinayversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The Court quashed both memos for violating natural justice and remitted the matter for a fresh, hearing‑based decision on the petitioners' pay.

Summary

The petitioners, a large group of employees, challenged the Department's memo dated 19.05.2022 which withdrew their previously confirmed grade‑pay of Rs 6600 (PB‑3, Pay Level 11) and ordered recovery of salary. They argued that no show‑cause notice or hearing was afforded before the memo’s issuance, violating natural justice. The State contended that no recovery had been effected but admitted the lack of notice. The Court held that both the 19.05.2022 memo and a subsequent 03.05.2023 memo were issued without any opportunity of hearing, thereby breaching principles of natural justice. Consequently, the Court quashed both memos, remitted the matter to the Department to issue show‑cause notices, conduct personal hearings, and pass a reasoned order within four months, and stayed any recovery pending a fresh decision. The writ petition was disposed.

Issues considered

  • Whether the Department's memos dated 19.05.2022 and 03.05.2023 were issued in violation of the principles of natural justice due to lack of show‑cause notice and hearing.
  • Whether the withdrawal of the previously granted grade‑pay and the order of recovery can be sustained.
  • Whether the Court can quash the impugned memos and direct the Department to take a fresh decision with due process.

                     3. During the course of argument, the learned Senior

counsel for the petitioners submits that no notice whatsoever has

been given to the petitioners before passing the impugned order

contained in Memo no. 1856 dated 19.05.2022 and on the basis

proceeding afresh in the matter, however no decision has been

         taken till date.

                     4. The learned counsel for the respondent-State

submits that no recovery has been made. However, the

representation of the petitioners have been considered and

rejected by the Department. He does not dispute the contention

of the learned Senior counsel for the petitioners that prior to

issuance of Annexure-2 to the writ petition i.e. Memo no. 1856

dated 19.05.2022, issued under the signature of the Director,

Scheduled Caste and Scheduled Tribe Welfare Department,

Government of Bihar, Patna, no opportunity of hearing or show-

cause notice was provided to the petitioners.

                     5. Considering the rival submissions and materials

available on record, this Court is of the opinion that the Memo

No. 1856 dated 19.05.2022 and Memo No. 1727 dated

03.05.2023 both issued under the signature of the Scheduled

Caste and Scheduled Tribe Welfare Department, Government of

Bihar, Patna, has been issued without giving any show-cause or

opportunity of hearing to the petitioners, which is in violation of

principles of Natural Justice. Accordingly, Memo No. 1856

dated 19.05.2022 and Memo No. 1727 dated 03.05.2023, are

         hereby quashed and set aside.

                                     6. The matter is remitted back to the respondent

authorities to take fresh decision regarding the fixation of the

pay of the petitioners, after issuance of show-cause notices to all

the petitioners herein. The respondent authorities shall afford the

petitioners an opportunity of personal hearing and thereafter

receipt/production of a copy of this order.

                                     7. Till a fresh decision is taken in the matter, no

recovery shall be effected from the petitioners.

                                     8. The writ petition is accordingly disposed of in the

                      aforementioned terms.

                                     9. Pending application(s), if any, shall also stand
