Holding

The court held that a writ petition may be withdrawn when the petitioner’s grievance is settled and the interim application is not pressed.

Summary

Dilip Kumar filed a civil writ petition (CWJC No.9296 of 2024) in the Patna High Court against the State of Bihar and several departmental officials. During the pendency of the petition, he filed Interim Application No.1 of 2024, which he later claimed had become infructuous. He subsequently informed the court that his grievance had been settled and sought permission to withdraw the writ petition. The court examined the claim that the interim application was not pressed and that the petitioner no longer required relief. Accordingly, the court granted permission to withdraw and disposed of the writ petition as withdrawn.
