The Court directed the Additional Collector to hear and dispose of the pending revision within four months and disposed of the writ petition.

Summary

The petitioner filed a writ petition seeking a direction to the Additional Collector, Muzaffarpur, to dispose of Revision Case No. 108/2023‑24, which challenged an order dated 24‑03‑2023 passed by the District Collector of Land Records in a mutation appeal. The petition highlighted that the revision had been pending for two years without any indication of disposal. The State counsel could not confirm whether the revision had been decided. The Court observed that the matter remained pending and directed the Additional Collector to take up the case, hear all parties, and dispose of it within four months. The Court further noted that if the case had already been disposed, no further action would be required. Accordingly, the writ petition was disposed with the said observation.

                               2. The present writ petition has been preferred for

                   grant of following relief(s):-

                                                “for issuance of appropriate

Patna High Court CWJC No.9469 of 2025(2) dt.24-03-2026
                                            2/3

2024 filed by the petitioner against the order
                            dated 24.03.2023 passed by D.C.L.R.,
Muzaffarpur in Mutation Appeal No. 15/2022-
23 which was also dismissed confirming the
order of C.O., Minapur as it is pending since
long and or pass such order/ orders which the
Hon’ble Court may deem fit and proper.”
                      3. It is unfortunate that even for disposal of the case,

people have to knock the doors of Patna High Court.

                      4. In the present case, the petitioner has come with a

limited prayer, to direct the respondents to dispose of the

Revision Case No. 108/23-24 preferred by him against the order

dated 24.03.2023 passed by the learned D.C.L.R., Muzaffarpur

          in Mutation Appeal No. 15/2022-23.

                      5. Learned State counsel submits that though he had

made correspondence with the State respondents, no further

instructions is the there whether the Revision case has been

disposed of or not. The year 2023-24 itself shows that for two

years, the case is pending before the learned Additional

          Collector, Muzaffarpur.

                      6. In that background, instead of keeping the case

pending, it is directed that the Additional Collector, Muzaffarpur

shall be taking up the matter at an earliest, shall be

noticing/hearing all the parties in Revision Case No. 108/23-24
Patna High Court CWJC No.9469 of 2025(2) dt.24-03-2026
                                                        3/3

whereafter, it shall be disposed of in next four months.

                                  7. The aforesaid order has been passed in the

background that the case is still pending before him. If the case

has been disposed of, no further steps is to be taken up.

                                  8. The writ petition is disposed of with the aforesaid

                      observation.
