Patna High Court

Ram Shankar JhaversusThe State of Bihar

Decided

DISPOSED

Holding

The Court held that denial of information under the RTI Act must be remedied by filing an appeal before the Central or State Public Information Officer, not by a writ petition.

Summary

Ram Shankar Jha filed a writ petition seeking documents related to his PDS licence after his RTI application was denied by the authority, which claimed the documents were unavailable. The petitioner argued that the authority should furnish the documents, while the State contended that the proper remedy is an appeal to the Central or State Public Information Officer under the RTI Act. The Court examined whether a writ petition could substitute for the statutory appeal mechanism. It concluded that the petitioner must pursue the appeal provided under the RTI Act and granted him liberty to do so within four weeks. The Court also directed the authority to dispose of any such appeal within twelve weeks and disposed of the writ petition.

Issues considered

  • Whether a writ petition is an appropriate remedy for denial of information under the Right to Information Act, 2005
  • Whether the Court can direct the authority to furnish documents when the RTI request has been denied
