Holding
The court held that the petitioners are similarly situated to the earlier appellants and are entitled to the same relief, directing the Director General of Police to dispose of their representations on pay fixation within four months after hearing.
Summary
The petitioners, members of the Bihar Armed Police, filed a writ petition seeking the implementation of a prior judgment (LPA No. 458/2021) that ordered refund of recovered amounts and restoration of pay fixation at the ACP scale. They contended that they are similarly situated to the earlier appellants and should receive the same benefits under the Bihar Litigation Policy, 2011. The court noted that earlier writ petitions (CWJC No. 14037/2025 and CWJC No. 5078/2025) had directed the Director General of Police to dispose of similar representations within a fixed period. Relying on those precedents, the court directed the DGP to dispose of the petitioners’ representations on pay fixation, after hearing, within four months and to pass a reasoned order. The order was issued without any cost order, thereby disposing of the writ petition on its merits.
Issues considered
- Whether the petitioners are covered by the judgment dated 26‑04‑2024 in LPA No. 458/2021 and thus entitled to the same relief as the earlier appellants.
- Whether the refusal to grant pay fixation at the ACP scale and to refund recovered amounts violates the Bihar Litigation Policy, 2011.
- Whether the respondent authorities are obligated to dispose of the petitioners’ representations within a stipulated time and pass a reasoned order.
