The Letters Patent Appeal is disposed of, confirming that the State must comply with the appointment order.

Summary

The State of Bihar appealed a Patna High Court order that directed the appointment of Ashiwini Bhardwaj as Lecturer in Arts & Craft at a Government Training College under the UR category, with the condition that he would receive benefits only from his actual date of joining. The State argued that the order should be set aside, while the respondent contended that a vacancy still existed and compliance would cause no difficulty. The Advocate General for the State was asked to verify the vacancy and later confirmed that the post remained vacant and the State could comply with the appointment order. On this basis, the Court disposed of the Letters Patent Appeal, effectively upholding the original appointment order. Consequently, the petitioner is to be appointed without any entitlement to seniority or pay from the date of earlier candidates.

Issues considered

  • Whether the State of Bihar is bound to comply with the High Court order appointing the petitioner to the vacant Lecturer post under the UR category
  • Whether the condition of denying seniority and pay from the earlier advertisement date is valid
