The court condoned the delay and restored the dismissed Second Appeal No.195 of 2009.

Summary

The petitioner, Yugal Prasad, filed an interlocutory application (IA No.01 of 2024) seeking condonation of a delay of over two years in filing a petition. The court examined whether the delay could be condoned under procedural law and whether the earlier dismissal of Second Appeal No.195 of 2009 for non‑compliance could be set aside. Relying on the reasons provided in the application, the court found the delay excusable and granted condonation. Consequently, the court allowed the IA and restored the dismissed appeal to its original file. The order also directed that any stay or substitution matters be dealt with in the restored appeal and that any pending applications be deemed disposed.

Issues considered

  • Whether the two‑year delay in filing the petition can be condoned.
  • Whether the dismissal of Second Appeal No.195 of 2009 for non‑compliance can be reversed and the appeal restored.
