Patna High Court

Army No.-14529716A Ex. HAV Fulman Singh (Advocate)versusThe State of Bihar through Sri Amrit Lal Meena, The Chief Secretary,

Decided
Disposal
DISPOSED

Holding

The Court held that no specific direction was made to the opposite parties, so the contempt application could not proceed.

Summary

The petitioner, Army No. 14529716A, filed an application seeking a contempt order against the State of Bihar and its officials for alleged willful disobedience of a High Court order dated 24 June 2024. The State counsel argued that no specific direction had been given to the opposite parties, and therefore they could not be held in contempt. The Court examined whether a clear, enforceable direction existed and whether the respondents’ conduct amounted to contempt. Finding that the order did not contain any explicit directive to the respondents, the Court concluded that the contempt proceedings could not be sustained. Consequently, the application for contempt was disposed of without any penalty.

Issues considered

  • Whether the opposite parties are in contempt for willful disobedience of the order dated 24‑06‑2024.
  • Whether the order contained a specific direction enforceable against the opposite parties.

Subjects

  • contempt of court
  • civil writ jurisdiction
  • disobedience of court order
  • high court procedure
  • no specific direction
