Holding

The court granted the petitioner liberty to approach the appropriate court and disposed of the contempt petition.

Summary

The petitioner, Ashish Kumar Sinha, filed a contempt petition seeking initiation of contempt proceedings against the State of Bihar and several officials of Bihar Agricultural University and Central Agricultural University, alleging willful disobedience of an earlier order dated 17 February 2020 in CWJC No.1043 of 2020. The petitioner argued that the opposite parties had issued an order contrary to the earlier direction and requested the court to enforce compliance. The court examined whether the alleged disobedience warranted contempt proceedings and whether the petitioner could be granted liberty to approach a suitable forum. The bench held that the petitioner should be allowed to move before the appropriate court for any remaining grievance. Consequently, the contempt petition was disposed of without further orders.

Issues considered

  • Whether the alleged willful disobedience of the order dated 17‑02‑2020 constitutes contempt of court
  • Whether the petitioner is entitled to liberty to approach another court for redress
  • Whether the contempt petition should be entertained or dismissed
