DISPOSED

Holding

The Court disposed of the contempt application, directing the petitioner to file a representation before the District Land Acquisition Officer and ordering the officer to decide the pending interest claim within a stipulated period.

Summary

The petitioner, Ravidra Singh, filed a miscellaneous application seeking contempt proceedings against the Divisional Commissioner, Munger (Opposite Party No.4), alleging willful disobedience of a judgment dated 09.01.2015 in C.W.J.C. No.7439 of 2013. The earlier judgment had ordered payment of compensation, which the petitioner claims has been made, but the interest component remains unpaid. The petitioner was directed to approach the District Land Acquisition Officer, Khagaria, to seek the pending interest. The Court allowed the petitioner to file a proper representation within four weeks and directed the officer to decide the matter with a reasoned order within another four weeks. It further held that any delay already incurred before the Court would be considered while condoning further delay, and the application was disposed accordingly.

Issues considered

  • Whether the Divisional Commissioner, Munger, is in contempt for willfully disobeying the judgment of 09.01.2015
