DISMISSED

Holding

The contempt petition is dismissed as the order dated 04‑12‑2018 has been complied with.

Summary

Satish Prasad Singh filed a contempt petition before the Patna High Court alleging that the State of Bihar had failed to comply with an order dated 04‑12‑2018 issued in Civil Writ Jurisdiction Case No. 5365 of 2017. The State contended that the order had been complied with because the Circle Officer, Parbatta, issued an order on 14‑03‑2019 rejecting the petitioner's claim, thereby satisfying the earlier directive. The Court examined whether the later order amounted to compliance with the original order and whether the contempt petition was maintainable. Finding that the Circle Officer's order effectively addressed the earlier order, the Court held that there was no breach. Consequently, the contempt petition was dismissed.

Issues considered

  • What constitutes compliance with the order dated 04‑12‑2018 in C.W.J.C. No. 5365 of 2017?
  • Whether the filing of a contempt petition is appropriate when the alleged non‑compliance has been remedied.
